Tom Deely is a solicitor specialising in trust and estate disputes. He acts for a range of clients on a variety of matters, including succession disputes, will challenges, and trust and administration disputes.

Tom is a Senior Associate in the Trusts and Estates Disputes team. He has extensive experience acting for a wide range of clients, from UHNW individuals to vulnerable clients and protected parties, both as claimants and defendants. He advises on a variety of complex matters including:

  • Complex cross-border succession disputes, involving issues of foreign assets, domicile, residence and applicable law, and the often conflicting interaction of civil and common law jurisdictions.
  • Will challenges and applications for rectification and construction of wills.
  • Trust and estate administration disputes and applications to compel the production of estate or trust accounts, to falsify / challenge those accounts, as well as applications for Public Trustee v Cooper type “blessing” applications.
  • Applications for the removal of trustees or personal representatives.
  • Claims under the Inheritance (Provision for Family and Dependants) Act 1975 including novel applications concerning cohabitants, minor children, spouses and persons being financially maintained by the Deceased.

Tom is a confident negotiator with significant experience of solicitor-led mediations and round-table meetings. Tom is a pragmatic and decisive litigator who prides himself on his technical knowledge and his client manner, ensuring that the client's needs are at the forefront of his advice.

Tom is a regular contributor to articles and publications is a member of the Association of Contentious Trust and Probate Specialists (ACTAPS) and ConTrA, a network for Contentious Trusts Associates.

 

Recent work
  • Acting for the children of the deceased in a complex high-value international succession dispute concerning the admissibility and presumed revocation of a will, and the deceased’s domicile and habitual residence. The dispute straddled a number of jurisdictions, including the BVI, Singapore, Belgium and England.
  • Successfully claiming a declaration of 100% beneficial ownership of a disputed property, securing costs on the indemnity basis.
  • Successfully defending a claim brought by a purported cohabiting-partner of the deceased under the Inheritance (Provision for Family and Dependants) Act 1975. Successfully opposing an application for interim provision under section 5 of the Act, in the first reported case to consider the merits requirements.
  • Successful application for a declaration of presumed death in a case giving rise to interesting domicile considerations. The missing person was born in Canada to a Canadian father and English mother who returned to England shortly after the birth.
  • Domicile dispute acting for the wife of the deceased in defending a claim brought by her step-son who contested the deceased’s domicile at the time of his death, asserting forced heirship rights.
